Effective from 1 November 2018, 89 modern awards were varied to include a provision requiring employers to pay an employee their final payment upon termination no later than seven (7) days after the day on which the employment ends.
To date, few modern awards have included provisions specifying when an employee’s final pay must be processed upon the termination of their employment. In the absence of such a provision, best practice has been to process an employee’s final pay on either their last day of work or on the next scheduled pay day.
Members should note this change DOES NOT affect the Manufacturing and Associated Industries and Occupations Award 2010 (which is the modern award covering Building Designers) but it DOES impact the Architects Award and the Clerks Award.
The Manufacturing Award is on a list of awards being reviewed.
